Terms of Use

Effective and Last Updated: July 24, 2026

1. Eligibility and Acceptance of These Terms

You must be at least 18 years old and legally able to enter into a binding agreement to use the Website. A parent, legal guardian, personal representative, or other authorized person may use the Website on behalf of another individual only when legally authorized to do so. By using the Website, you represent that you meet these requirements and agree to comply with these Terms and all applicable laws.

2. About MedEx for Vets

MedEx for Vets is a private, independent medical evaluation company. Services may include medical record reviews, independent medical examinations, Disability Benefits Questionnaire (DBQ) completion, and medical nexus letters when medically appropriate and supported by the available evidence.

Services may be offered to veterans and claimants throughout the United States and, when permitted, to individuals living abroad. Availability depends on professional licensing, scope-of-practice requirements, applicable law, the claimed medical condition, the records available, the type of evaluation requested, and documentation requirements. Website descriptions do not guarantee that a particular service will be available or appropriate for a specific person or condition.

3. No Affiliation With the Department of Veterans Affairs

MedEx for Vets is not part of, employed by, endorsed by, contracted by, sponsored by, or acting on behalf of the United States Department of Veterans Affairs (VA) or any other government agency. References to the VA, VA disability benefits, VA forms, DBQs, C&P examinations, or government programs are used only to explain the nature of our independent services.

Government names, seals, forms, logos, publications, and other government materials remain the property of their respective owners. Their appearance or mention on the Website does not indicate government affiliation, approval, or endorsement.

4. No Legal Advice, Claims Filing, or Representation

MedEx for Vets does not provide legal advice, legal representation, claims filing, claims management, appeal services, or VA-accredited representation. We do not prepare, submit, prosecute, appeal, or manage a VA disability claim on your behalf unless a separate written agreement expressly states otherwise and the activity is legally permitted.

You are responsible for submitting your own claim, appeal, medical evidence, and supporting documents to the VA unless you separately engage an authorized representative. Anyone needing claims or legal assistance should consult a VA-accredited Veterans Service Organization representative, claims agent, or attorney.

5. No Medical Treatment or Treating-Provider Relationship

Website content and preliminary consultations are provided for general informational and independent medical evaluation purposes only. They are not personal medical advice and are not a substitute for diagnosis, treatment, medication management, or care from a treating healthcare professional.

Accessing the Website, submitting a form, scheduling or participating in a free consultation, exchanging messages, or reviewing Website materials does not create a physician-patient, nurse practitioner-patient, provider-patient, fiduciary, or other treating relationship. Any professional relationship that may later arise is limited to the independent evaluation services described in a separately signed consent and service agreement.

MedEx for Vets does not provide primary care, urgent care, emergency care, prescriptions, medication management, psychotherapy, crisis intervention, or ongoing treatment. Continue to see your treating clinicians for medical care.

6. Emergency and Crisis Information

Do not use the Website, consultation form, email, portal, or other MedEx for Vets communication channel for an emergency or urgent medical need. If you have a medical emergency, call 911 or go to the nearest emergency department. If you are a veteran in crisis or are concerned about one, dial 988 and press 1 or text 838255. MedEx for Vets does not monitor Website communications continuously and cannot guarantee an immediate response.

7. Consultations, Case Screening, and Case Acceptance

A free 15-minute consultation is a preliminary opportunity to discuss the requested service and determine whether MedEx for Vets may be able to assist. It is not a complete medical record review, examination, diagnosis, or final medical opinion.

Submitting a consultation request or participating in a consultation does not require MedEx for Vets to accept a case. We may decline a request when the service is outside our scope or availability, an appropriate evaluation cannot be completed, the records are insufficient, a requested opinion is not medically supportable, a conflict exists, or for any other lawful professional or business reason. No services begin until the required consent and service documents are completed and the case is expressly accepted.

8. Objective Evaluations and No Guaranteed Outcome

Medical reviews, examinations, DBQs, and nexus opinions are based on the information available, including records provided, claimant-reported history, examination findings when applicable, current medical knowledge, applicable standards, and independent professional clinical judgment. We will not alter, omit, exaggerate, or misrepresent findings to obtain a desired claim result.

MedEx for Vets does not guarantee a favorable medical opinion, completion of a particular form or letter, VA acceptance of any document, service connection, a disability percentage, claim approval, payment of benefits, or any other result. Final decisions are made by the VA or other applicable adjudicating authority. Prior outcomes, examples, testimonials, educational content, and general discussions do not guarantee the same or similar result for another person.

9. Separate Consent and Service Agreements

These Terms govern use of the Website. Paid services are also governed by the written consent, service agreement, authorization, invoice, payment terms, telehealth consent, and other documents provided for the specific engagement (collectively, the "Service Documents").

If these Terms conflict with a signed Service Document, the signed Service Document controls with respect to the paid professional service, fees, timelines, deliverables, cancellation rules, records, revisions, or other engagement-specific matters. These Terms continue to govern general Website access and use.

10. Fees, Payments, Scheduling, and Deliverables

The Website may describe available services or permit consultation scheduling, but fees and service details are confirmed during the consultation or in the Service Documents. Fees, deposits, cancellation or rescheduling charges, payment deadlines, refund terms, report-release requirements, and estimated completion timelines are governed by the applicable Service Documents and invoice.

Any estimated timeline is not guaranteed and may change because of incomplete or late records, additional information requests, case complexity, scheduling, technical issues, professional availability, or events beyond our reasonable control. MedEx for Vets is not responsible for VA filing deadlines or other deadlines unless expressly accepted in a signed writing.

11. Your Information, Records, and Responsibilities

You agree to provide information that is complete, accurate, current, and truthful to the best of your knowledge. You are responsible for reviewing your submissions and promptly correcting material errors. You must have the legal right and authority to submit any records, images, statements, or other information you provide.

  • Do not alter, fabricate, conceal, or misrepresent medical records, service records, symptoms, examination findings, dates, or other evidence.
  • Provide requested records and information within a reasonable time. Missing, inaccurate, incomplete, or unavailable information may delay, limit, or prevent completion of a service.
  • Keep your contact information current and monitor the communication methods you provide.
  • Do not submit information about another person unless you are legally authorized to do so.
  • Review completed documents for clerical or demographic errors and report them promptly. Medical conclusions will be changed only when supported by evidence and professional judgment.

12. Sensitive Information and Secure Submission

Do not submit Social Security numbers, payment-card or bank information, passwords, government identification numbers, or complete medical records through the initial consultation form. If records are needed, MedEx for Vets will provide instructions for submitting them through an approved secure method.

Use the secure portal, secure upload link, or other approved method when instructed. Regular email and text messaging may carry privacy risks. Although reasonable safeguards are used, no website, transmission method, or storage system can be guaranteed to be completely secure. You are responsible for using reasonable security practices, including protecting your devices, passwords, account access, and shared links.

13. Accounts, Portals, and Electronic Communications

If you receive access to a portal or account, you must keep login credentials confidential and may not allow unauthorized use. Notify MedEx for Vets promptly if you suspect unauthorized access, loss of credentials, or misuse of your account. You are responsible for activity occurring through your account to the extent permitted by law.

By providing an email address or telephone number, you consent to receive service-related communications by email, telephone, text message, secure portal, scheduling platform, or video platform, as permitted by law and your communication preferences. Standard carrier or data charges may apply. Electronic signatures and acknowledgments may be used and may have the same legal effect as handwritten signatures when permitted by law.

14. Telehealth and Remote Evaluation Features

Telehealth independent medical examinations may be available only for select conditions and only when clinically appropriate and permitted by applicable professional licensing, scope-of-practice rules, local law, and documentation standards. Some conditions require an in-person examination, physical testing, measurements, imaging, laboratory testing, or other information that cannot be obtained remotely.

Technical interruptions, inadequate audio or video, privacy concerns, safety issues, inability to verify identity or location, or insufficient clinical information may require rescheduling, an in-person evaluation, or discontinuation of the remote session. Unless prior written permission is obtained, you may not photograph, audio-record, video-record, stream, or otherwise reproduce a consultation or evaluation.

15. Privacy

Our collection, use, retention, and disclosure of personal information through the Website are described in the Privacy Policy and applicable Notice at Collection. The Privacy Policy is incorporated into these Terms by reference. Separate HIPAA authorizations, communication consents, and privacy forms may apply to professional services and protected health information.

Review the Privacy Policy.

16. Acceptable Use and Prohibited Conduct

You may use the Website only for lawful, personal, and legitimate purposes consistent with these Terms. You may not:

  • Violate any law, regulation, court order, contractual obligation, or another person's rights.
  • Misrepresent your identity, authority, military service, medical history, claim status, or relationship with another person or organization.
  • Upload or transmit malware, harmful code, corrupted files, unsolicited bulk messages, or content designed to disrupt or damage systems.
  • Attempt to gain unauthorized access to the Website, portal, accounts, servers, records, or security features, or test vulnerabilities without written authorization.
  • Scrape, crawl, harvest, copy, index, mirror, frame, or use automated tools to access Website content except through ordinary search-engine indexing or with written permission.
  • Use Website content, forms, designs, reports, templates, or branding to create a competing service, mislead others, or suggest affiliation or endorsement.
  • Harass, threaten, abuse, defame, exploit, or interfere with MedEx for Vets, its personnel, contractors, providers, other users, or third parties.
  • Submit false, fraudulent, altered, unlawfully obtained, or infringing information or records.

17. Intellectual Property and Limited License

The Website and its original text, graphics, layout, design, logos, brand elements, educational materials, compilations, and other content are owned by or licensed to MedEx for Vets and are protected by applicable intellectual-property laws. MedEx for Vets and related names, logos, and slogans may not be used without prior written permission.

Subject to these Terms, you receive a limited, revocable, nonexclusive, nontransferable license to access and use the Website for personal, noncommercial purposes. You may print or save a reasonable copy of publicly available educational content for your own use, provided all notices remain intact. No other right or license is granted.

Government forms, links, publications, and third-party materials remain the property of their respective owners. Nothing on the Website transfers ownership of those materials to MedEx for Vets or to you.

18. Third-Party Websites and Service Providers

The Website may link to or use third-party services, such as government websites, scheduling systems, portals, video platforms, hosting providers, CAPTCHA or security tools, analytics tools, and payment processors. Third parties may have separate terms and privacy policies. MedEx for Vets does not control and is not responsible for the availability, accuracy, security, content, practices, or performance of third-party services.

A link or technical integration does not constitute endorsement. You access third-party services at your own discretion and should review their applicable terms and privacy notices.

19. Website Availability, Updates, and Errors

We may modify, suspend, restrict, or discontinue any part of the Website at any time. We do not guarantee uninterrupted access, error-free operation, compatibility with every device, preservation of submissions, or that defects will be corrected immediately.

We attempt to keep Website information accurate and current, but content may contain typographical, technical, or other errors and may become outdated. We may correct or update content without notice. You should confirm important service details directly with MedEx for Vets and should not rely on the Website to meet a legal, VA, medical, filing, appeal, or benefits deadline.

20. Disclaimer of Warranties

To the fullest extent permitted by law, the Website and all publicly available content are provided "as is" and "as available," without warranties of any kind, whether express, implied, statutory, or otherwise. MedEx for Vets disclaims implied warranties of merchantability, fitness for a particular purpose, title, non-infringement, accuracy, availability, security, and any warranty arising from course of dealing or usage of trade.

MedEx for Vets does not warrant that the Website will meet your requirements, that access will be uninterrupted or secure, that content is complete or error-free, or that use of the Website will produce a particular medical, legal, financial, administrative, or VA claim result. Some jurisdictions do not allow certain warranty exclusions, so some exclusions may not apply to you.

21. Limitation of Liability

To the fullest extent permitted by law, MedEx for Vets and its owners, officers, employees, contractors, professionals, agents, licensors, and service providers will not be liable for indirect, incidental, special, exemplary, punitive, or consequential damages; loss of data, revenue, profits, benefits, opportunity, or goodwill; or damages arising from Website interruption, unauthorized access, third-party services, reliance on public content, or failure to meet a deadline.

These limitations apply regardless of the legal theory and even if the possibility of damages was known. They do not exclude liability that cannot lawfully be limited, including rights that cannot be waived under applicable consumer law. Liability relating to a paid professional service is governed by the applicable signed Service Documents.

22. Indemnification

To the extent permitted by law, you agree to defend, indemnify, and hold harmless MedEx for Vets and its owners, officers, employees, contractors, professionals, agents, licensors, and service providers from claims, losses, liabilities, damages, judgments, costs, and reasonable attorneys' fees arising from your unlawful or unauthorized use of the Website, violation of these Terms, infringement of another person's rights, misuse of an account or portal, or submission of false, altered, unauthorized, or infringing information. This obligation does not apply to the extent a claim results from the protected party's own unlawful conduct or negligence where indemnification is prohibited by law.

23. Suspension and Termination

We may restrict, suspend, or terminate Website or portal access when we reasonably believe these Terms have been violated; access creates a security, legal, privacy, safety, or operational risk; fees remain unpaid under an applicable agreement; or restriction is otherwise lawful and appropriate. Termination does not eliminate obligations or rights that arose before termination. Provisions that by their nature should survive will remain effective, including intellectual property, disclaimers, liability limitations, indemnification, governing law, and dispute provisions.

24. International Access

The Website is operated from the United States. Individuals accessing it from another country are responsible for compliance with local law. Information submitted from outside the United States may be transferred to, stored in, and processed in the United States, subject to the Privacy Policy and applicable law. The availability of professional services outside a particular state or country is not guaranteed and may be limited by licensing, scope-of-practice, local-law, and service-availability requirements.

25. Governing Law and Venue

These Terms are governed by the laws of the State of California, without regard to conflict-of-law principles, except where federal law applies or applicable consumer law requires otherwise. Subject to any nonwaivable rights, any court proceeding arising primarily from use of the Website must be brought in a state or federal court with jurisdiction in San Diego County, California, and the parties consent to personal jurisdiction and venue there.

Nothing in these Terms prevents either party from seeking appropriate emergency or injunctive relief, reporting a matter to a government agency, or exercising a right that cannot legally be waived.

26. Changes to These Terms

We may revise these Terms from time to time. The revised Terms will be posted on the Website with an updated effective date. Changes apply prospectively unless otherwise stated or required by law. Your continued use of the Website after revised Terms become effective constitutes acceptance of the revised Terms. If you do not agree with a revision, stop using the Website.

27. General Provisions

If any provision of these Terms is held invalid or unenforceable, it will be enforced to the maximum extent permitted and the remaining provisions will remain in effect. Failure to enforce a provision is not a waiver. You may not assign your rights or obligations under these Terms without our written consent; MedEx for Vets may assign these Terms as part of a merger, reorganization, transfer of assets, change of control, or other lawful business transaction.

These Terms, together with the Privacy Policy and any applicable Service Documents, constitute the complete agreement concerning the matters they address. Headings are for convenience only. The words "including" and "such as" are illustrative and do not limit the preceding language.
